Terms & Conditions of Service

Effective Date: October 4, 2026

These Terms and Conditions ("Agreement") govern all fire protection design, installation, inspection, and consulting services provided by Fire Atlanta LLC, a wholly owned subsidiary of Aqua Emberstone LLC. By engaging our services, Customer agrees to the following stipulations. 

Pricing & Material Fluctuations

All proposals are based on material prices at the time of the bid. Due to market volatility, contract amounts are subject to increase if Fire Atlanta LLC incurs higher costs for steel pipe or other essential materials between the contract execution and project delivery, provided such increases are not due to our negligence. Furthermore, Fire Atlanta LLC shall be entitled to time extensions for delays caused by material shortages or delivery failures outside of our direct control. 

Payment Terms & Deposits

Time is of the essence for both parties. Payment is due immediately upon receipt of invoice. For residential service calls, payment must be remitted in full on-site at the time of service completion. Certain commercial projects may require a nonrefundable deposit prior to mobilization. 

  • Late Fees: A monthly service charge of 1.5% (18% per annum), or the highest rate allowed by law, will be applied to balances unpaid after 30 days. Interest will be added as principal to all unpaid balances and will continue to accrue until paid in full. 
  • Remedies: Fire Atlanta LLC reserves the right to pursue all available legal remedies for uncollected debts, including but not limited to the filing of mechanical liens.

Customer & Property Management Responsibilities

  • Site Preparation: Property management or ownership must notify tenants of work locations. Customers are required to relocate items located under or around fire sprinkler heads; Fire Atlanta LLC is not responsible for water damage to items left in active work zones during normal operations. 
  • System Blueprints: Property management must provide existing system plans to ensure proper pipe routing. We are not liable for systems that cannot be safely shut down due to a lack of blueprints or facility awareness. 
  • Cancellations: If scheduled work is canceled by the property with less than 24 hours of notice, Fire Atlanta LLC reserves the right to assess a cancellation fee covering associated employee or subcontractor costs.

Operational Limitations & Liability

  • Drainage: If a system fails to drain properly through the main or auxiliary drains as required by NFPA 13, Fire Atlanta LLC is not liable for excessive trapped water. We are not responsible if more than one gallon of water escapes from a single sprinkler head under these conditions. 
  • Structural Debris: If work on fire sprinkler or alarm devices causes sheetrock or ceiling materials to fall, break, or chip, Fire Atlanta LLC's liability is strictly limited to broom-cleaning the floor or tenant items. 
  • CPVC Repairs: Repairs requiring CPVC piping mandate a strict 24-hour shutdown before water pressure is restored after the final glue joint is made. Customers requiring faster restoration must execute a separate Release of Liability waiver. 
  • Warranties: Materials and workmanship are under warranty for 30 days from the date of installation or service. If a customer disputes a warranty claim and the issue is deemed unrelated to material defect or Fire Atlanta LLC's workmanship, standard service rates will apply. Fire Atlanta LLC makes no express or implied warranties regarding the adequacy or design of systems originally installed by third parties.

Exclusions

Fire Atlanta LLC explicitly excludes liability for the following:

  • Water damage resulting from systems lacking proper auxiliary drains or failing to drain per NFPA 13. 
  • Pre-existing conditions of pipes, components, or sprinkler heads (including heads installed improperly with pipe sealant). 
  • Acts of God, nature, or vandalism to delivered or installed equipment. 
  • Incidental or consequential damages, including business interruption, cosmetic damage, leaks, or cleaning costs beyond standard broom-clean, unless caused by solely negligent acts or intentional misconduct. 
  • Costs for access restrictions, fire watches, or customer personnel. 
  • Overtime or premium labor (standard hours are 8:00 AM – 5:00 PM, Mon-Fri). 
  • Permits, drawings, site work, mold/asbestos/lead abatement, after-hours work, or fire pump/backflow preventer installations unless explicitly noted in the contracted scope of work.

Modifications to the contracted scope of work entitle Fire Atlanta LLC to equitable pricing adjustments. No variance to these terms is binding without the express written consent of Fire Atlanta LLC.
